The trial of the leader of the Indigenous People of Biafra (IPOB) Nnamdi Kanu is set to commence today, September 26, at the Federal High Court in Abuja.
The IPOB leader is facing three criminal charges alongside two others – Benjamin Madubgwu and David Nwawuisi -before Justice John Tsoho.
Kanu’s trial suffered a setback on June 20, when the second defendant in the matter, Madubugwu sacked the counsel Chuks Muoma, representing him in the case.
The second defendant on the same date also informed the court that a new counsel and senior advocate of Nigeria Amobi Nzelu will continue with his legal representation.
Having announced his appearance for the second defendant, Nzelu further prayed the court to permit him substantial time to study the court earlier proceedings on the matter.
Unfortunately, Nzelu was later sacked by the second defendant after his statement at a press briefing that the IPOB group had no link with the militant group, the Niger Delta Avengers.
This means that the second defendant having sacked his new counsel is expected to appear in court today with a new legal representative.
Meanwhile, just yesterday, the IPOB leaders and the other defendants petitioned the chairman of the National Judicial Council (NJC), seeking for an investigation into two different and conflicting rulings giving by Justice Tsoho on the protection of prosecution witnesses in the matter.
In the petition written by Ifeanyi Ejiofor on behalf of the IPOB leader said that Justice Tsoho in the ruling breached judicial oath by taking an oral application from the federal government in a matter he had already ruled on.
