Nollywood Actor: Elder Maya is dead

On September 30, beloved veteran Nollywood actor Elder Maya passed away after months of battling with a liver illness.

Martins Njubuigbo aka Elder Maya was a beloved Nollywood actor who featured in many films, and loved to feature in films which were based on Nigerian villages.

Sadly, the veteran actor is said to have passed away today October 1, after months of battling with a liver related illness. Fellow actor Yomi Fabiyi was the first to announce his death on Instagram. See below:
 

He said: “RIP Elder Mayah. You were a veteran and a hard-working one at that. Journey well papa. My concerns and sympathy with his families and close colleagues.”

He will be missed by fans and fellow actors. May he rest in perfect peace.

Edo election: INEC raises alarm over the distribution of money

   
– The Independent National Electoral Commission (INEC) has raised an alarm over the just concluded Edo governorship election

– INEC has called for collective efforts towards addressing inducement of voters with money by political parties

– The commission says the situation was a major feature of the Edo polls

The Independent National Electoral Commission (INEC) has expressed its concerns over the inducement of voters with money by political parties at the just concluded governorship election in Edo state.

INEC deputy director on voter education and publicity, Nick Dazang made the call in an interview with the News Agency of Nigeria yesterday, September 30.

Dazang said the commission was troubled by reports it received on alleged inducement of voters in the just concluded Wednesday governorship election in Edo state.

His words: “The commission received about 29 calls and SMSs alleging that some people were inducing voters with money during the election.

“The reports which are from different bodies and monitoring group indicated that major political parties were involved in the ugly incident.

“We are troubled by it and I am saying that over voting and the use of money as inducement to voters is of concern to us and other stakeholders.

“Going forward we need to put this on the agenda, discuss and address it squarely before it become another major challenge to our electoral process.”

Dazang however advised voters not to allow themselves to be financially-induced during elections, adding that it amounted to selling their future.

“This is something that is rearing its ugly head and it has implication for the electoral process.

“When you collect money and vote for a person, it means you are mortgaging your right. Also that person you are collecting money from may not be able to deliver dividends of democracy to you.

“This is a right that is as ineligible as your right to life, your right to education, your right to religion freedom. All these are enshrined in the United Nations declaration.

“For you now to take money and forget your conscience shows that you are now mortgaging also your rights to vote for a candidate of your choice.

“You have equally mortgaged your right to make the man accountable at the end of the day,” he said.

The just concluded election in Edo state was marred with reports of violence, ballot snatching and financial inducement by the major parties in the poll – the All Progressives Congress and the Peoples Democratic Party (PDP).

Meanwhile, the PDP has attacked President Muhammadu Buhari for being partial in his reaction after the results of the Edo election were announced.

The opposition party claimed that President Buhari’s actions were divisive, partisan and unfair for someone in his position as the country’s number one citizen.

Woman discharges maggot from her private part

  
In Olakula area, Ipokia local government area of Ogun state, a woman identified as Iya Toheeb was reported on Wednesday, September 28, to have been continuously discharging maggot from her private part.

According to The Nation, the scene turned chaotic as residents trooped out to see the woman sat in a car with the assistance of family members and sympathizers. It was thought that she might have been a victim of money-making ritual after her condition allegedly defied orthodox medication.

It was gathered that the woman was also brought to one of the men she was associated with, a carpenter in the community. Of the reason for bringing the afflicted woman to the man, a source at the scene who asked not to be named, said:

“The woman was brought to the carpenter who was her former husband. Her family members believed that the man may be responsible for her worsening condition that defied treatment in hospital where she was admitted for months. Doctors were said to have advised her relatives to seek alternative medicine to her ill-health because it had gone beyond the purview of orthodox medicine.”

Another source, who did not want her name in print, said: “The woman had dated different men in the past and it is believed that she may have been used for money-making ritual going by what we heard from those who know her.”

At the scene, sympathizers helped spread a sack on the car seat on which the woman sat when the maggots continued to drop even as a stench emanating from her body fouled the air. “This is what my beauty has done to me o,” said the woman shortly before being taken away by her family members.

Buhari's Independence Day Speech - 'The recession will not last, I will deal with Niger Delta militants'

     
President Muhammadu Buhari has assured Nigeria that his administration was working hard to reposition Nigeria for prosperity, urging them not to be deterred by the current economic crisis, saying that it would not last for so long.

The president who recalled his promises to Nigerians during his campaigns as a presidential candidate stated that he would not deviate from he hallmark of transparency and honesty. The remarks were contained in his broadcast Saturday morning to commemorate the 56th Independence anniversary of Nigeria.

He said: “Today – 1st October is a day of celebration for us Nigerians. On this day, 56 years ago our people achieved the most important of all human desires – freedom and independence. We should all therefore give thanks and pray for our founding fathers without whose efforts and toil we would not reap the bounties of today.

“I know that uppermost in your minds today is the economic crisis. The recession for many individuals and families is real. For some It means not being able to pay school fees, for others it’s not being able to afford the high cost of food (rice and millet) or the high cost of local or international travel, and for many of our young people the recession means joblessness, sometimes after graduating from university or polytechnic.

“I know how difficult things are, and how rough business is. All my adult life I have always earned a salary and I know what it is like when your salary simply is not enough.

In every part of our nation people are making incredible sacrifices. “But let me say to all Nigerians today, I ran for office four times to make the point that we can rule this nation with honesty and transparency, that we can stop the stealing of Nigeria’s resources so that the resources could be used to provide jobs for our young people, security, infrastructure for commerce, education and healthcare. “I ran for office because I know that good government is the only way to ensure prosperity and abundance for all. I remain resolutely committed to this objective.

“I believe that this recession will not last.”

We have defeated Boko Haram to provide security for our people Highlighting his achievements in the last one and half years of his government, president Buhari places security ahead, saying that Boko haram had been defeated. “Temporary problems should not blind or divert us from the corrective course this government has charted for our nation.

We have identified the country’s salient problems and we are working hard at lasting solutions. “To re-cap what I have been saying since the inception of this administration, our problems are security, corruption and the economy, especially unemployment and the alarming level of poverty. “On Security, we have made progress. Boko Haram was defeated by last December – only resorting to cowardly attacks on soft targets, killing innocent men, women and children. “Nigerians should thank our gallant men of the Armed Forces and Police for rescuing large areas of the country captured by insurgents.

Now, residents in Borno, Yobe and Adamawa States, as well as several neighbouring states go about their daily business in relative safety. People can go to mosques, churches, market places in reasonable safety. “Commuters can travel between cities, towns and villages without fear. Credit for this remarkable turn-round should go to our Armed Forces, the Police, various sponsored and private vigilante groups, the local traditional leaders.

Security is a top to bottom concern and responsibility. “Besides Boko Haram, we are confronting other long-running security issues, namely herdsmen vs farmers, cattle rustling, kidnappings. This Administration is firmly resolved to tackle these challenges and to defeat them.”

I will deal with Niger-Delta militants

Disturbed by the incessant blowing up of oil and gas installations in the Niger-Delta, the president reiterated his threat to militants. He said: A new insurgency has reared up its head in the shape of blowing up gas and oil pipelines by groups of Niger Delta Militants. This Administration will not allow these mindless groups to hold the country to ransom.

“What sense is there to damage a gas line as a result of which many towns in the country including their own town or village is put in darkness as a result? What logic is there in blowing up an export pipeline and as a result income to your state and local governments and consequently their ability to provide services to your own people is reduced? “No group can unlawfully challenge the authority of the Federal Government and succeed.

Our Administration is fully sympathetic to the plight of the good people of Niger Delta and we are in touch with the State Governments and leaderships of the region. It is known that the clean-up of the Ogoniland has started. Infrastructural projects financed by the Federal Government and post amnesty programme financing will continue. “We have however, continued to dialogue with all groups and leaders of thought in the region to bring lasting peace.

Corruption must be fought headon

“Corruption is a cancer which must be fought with all the weapons at our disposal. It corrodes the very fabric of government and destroys society. Fighting corruption is Key, not only to restoring the moral health of the nation, but also to freeing our enormous resources for urgent socio-economic development.

“In fighting corruption, however, the government would adhere strictly by the rule of law. Not for the first time I am appealing to the judiciary to join the fight against corruption. “The Third Plank in this Administration’s drive to CHANGE Nigeria is re-structuring the economy. Economies behaviour is cyclical. All countries face ups and downs. Our own recession has been brought about by a critical shortage of foreign exchange.

Oil price dropped from an average of hundred USD per barrel over the last decade to an average of forty USD per barrel this year and last. “Worse still, the damage perpetrated by Niger Delta thugs on pipelines sometimes reduced Nigeria’s production to below One million barrels per day against the normal two point two million barrels per day. Consequently, the naira is at its weakest, but the situation will stabilize. “But this is only temporary. Historically about half our dollar export earnings go to importation of petroleum and food products! Nothing was saved for the rainy days during the periods of prosperity. We are now reaping the whirlwinds of corruption, recklessness and impunity.

How we are providing solutions to economic crisis There are no easy solutions, but there are solutions nonetheless and Government is pursuing them in earnest. We are to repair our four refineries so that Nigeria can produce most of our petrol requirements locally, pending the coming on stream of new refineries.

That way we will save ten billion USD yearly in importing fuel. “At the same time, the Federal Ministry of Agriculture and the Central Bank have been mobilized to encourage local production of rice, maize, sorghum, millet and soya beans. Our target is to achieve domestic self-sufficiency in these staples by 2018. “Already farmers in thirteen out of thirty six states are receiving credit support through the Central Bank of Nigeria’s Anchor Borrowers Programme.

Kebbi state alone this year is expected to produce one million tonnes of locally grown rice, thanks to a favourable harvest this year. As part of the 13 states, Lagos and Ogun are also starting this programme. Rice alone for example costs Nigeria two billion USD to import. “The country should be self-sufficient in basic staples by 2019. Foreign exchange thus saved can go to industrial revival requirements for retooling, essential raw materials and spare parts.

It is in recognition of the need to re-invigorate agriculture in our rural communities that we are introducing the LIFE programme. “Government recognises that irrigation is key to modern agriculture: that is why the Ministries of Agriculture and Water Resources are embarking on a huge programme of development of lakes, earth dams and water harvesting schemes throughout the country to ensure that we are no longer dependent on rain-fed agriculture for our food requirements. “In addition, government is introducing Water Resources Bill encompassing the National Water Resources Policy and National Irrigation and Drainage Policy to improve management of water and irrigation development in the country. We are reviving all the twelve River Basin Authorities, namely;

III. Chad Basin
IV. Cross River
V. Hadejia – Jama’are
VI. Lower Benue
VII. Lower Niger
VIII. Niger Delta
IX. Ogun – Osun
X. Sokoto – Rima

“The intention is eventually to fully commercialise them to better support crop production, aqua –culture and accelerated rural development. “This Administration is committed to the revival of Lake Chad and improvement of the hydrology and ecology of the basin.

This will tune in with efforts to rehabilitate the thirty million people affected by the Boko Haram insurgency in the Lake Chad basin countries. “The second plank in our economic revival strategy is centred on the Ministry of Power, Works and Housing. The Ministry will lead and oversee the provision of critical infrastructure of power, road transport network and housing development.

“Power generation has steadily risen since our Administration came on board from three thousand three hundred and twenty four megawatts in June 2015, rising to a peak of five thousand and seventy four megawatts in February 2016.

“For the first time in our history the country was producing five thousand megawatts. However, renewed militancy and destruction of gas pipelines caused acute shortage of gas and constant drop in electricity output available on the grid. “There has been during the period June 2015 to September 2016 big improvement in transmission capacity from five thousand five hundred megawatts to the present seven thousand three hundred megawatts. “There were only two system collapses between June and December 2015, but due to vandalism by Niger Delta militants the over-all system suffered 16 system collapses between March and July 2016 alone.

As I have said earlier, we are engaging with responsible leadership in the region to find lasting solutions to genuine grievances of the area but we will not allow a tiny minority of thugs to cripple the country’s economy. “In the meantime, government is going ahead with projects utilizing alternate technologies such as hydro, wind, and solar to contribute to our energy mix. In this respect, the Mambilla Hydro project, after many years of delay is taking off this year. Contract negotiations are nearing completion with Chinese firms for technical and financial commitments.

“The project is to be jointly financed by Nigeria and the Chinese-Export-Import Bank. In addition, fourteen Solar Power Projects have had their power purchase agreements concluded. Hence the plan to produce one thousand two hundred megawatts of solar electricity for the country would be realized on schedule. “And in line with the objective of government to complete all abandoned projects across the country, the Rural Electrification Agency’s projects needing completion are provided for in the 2016 Budget. Bringing electricity to rural areas will help farmers, small scale and cottage industries to integrate with the national economy.

Road construction

“Roads Construction and Rehabilitation has taken off. The sum of twelve billion naira was allocated to this sector in the 2015 Budget, not enough even to pay interest on outstanding unpaid claims. “Notwithstanding the budgetary constraints, the current budget allocated two hundred and forty billion naira for highway projects against twelve billion naira in 2015.

Many contractors who have not been paid for three years have now remobilized to sites. Seven hundred and twenty point five billion naira has so far been released this budget year to capital projects. “The Ministry of Power, Works and Housing has received one hundred and ninety seven point five billion naira. Work on the following highways has now resumed.

1. Dualization of Calabar – Itu Road in Cross River/Akwa Ibom States.
2. Dualization of Lokoja – Benin Road, Ehor – Benin city, Edo State.
3. Re-construction of outstanding sections of Benin – Shagamu Express way, Edo/Ogun States.
4. Expansion works on Lagos – Ibadan Dual carriageway, Ogun/Oyo States
5. Rehabilitation of Onitsha – Enugu Expressway, Anambra/Enugu States.
6. Rehabilitation and Reconstruction of Enugu – Port Harcourt Dual carriageway, Abia/Rivers States.
7. Rehabilitation of Hadejia – Nguru Road, Jigawa State.
8. Dualization of Kano – Katsina Road, Kano State.
9. Dualization of Kano – Maiduguri Road, Borno State.
10. Dualization of Azare – Potiskum Road, Azare – Sharuri Road, Bauchi State.
11. Rehabilitation of Ilorin – Jebba – Mokwa – Birnin Gwari Road, Kwara State.
12. Construction of Oju/Lokoja – Oweto Bridge over River Benue, Benue State.

“Other major highways are in the queue for rehabilitation or new construction. “Already contractors have recalled about nine thousand workers laid off and Government expects that several hundreds of thousands of workers will be reengaged in the next few months as our public works programme gains momentum.

Railways

“On railways, we have provided our counterpart funding to China for the building of our standard gauge Lagos -Kano railway. Meanwhile, General Electric is investing two point two billion USD in a concession to revamp, provide rolling stock, and manage the existing lines, including the Port Harcourt-Maiduguri Line. The Lagos-Calabar railway will also be on stream soon. “We have initiated the National Housing Programme. In 2014 four hundred million naira was voted for Housing.

In 2015 nothing. Our first budget this year is devoting thirty five point six billion naira. Much of the house building will be private – sector led but Government is initiating a pilot housing scheme of two thousand eight hundred and thirty eight units uniformly spread across the 36 states and FCT. “We expect these units to be completed within 4 – 6 months.

These experimental Nigeria House model Units will be constructed using only made in Nigeria building materials and components. This initiative is expected to reactivate the building materials manufacturing sector, generate massive employment opportunities and develop sector capacity and expertise. “The programmes I have outlined will revive the economy, restore the value of the naira and drive hunger from our land.

Restoring Nigeria’s image abroad “Abroad, Nigeria’s standing has changed beyond belief in the last 18 months. We are no longer a pariah state. Wherever I go, I have been received with un-accustomed hospitality.

Investors from all over the world are falling over themselves to come and do business in Nigeria. This government intends to make business environment more friendly because we can not develop ourselves alone. “All countries, no matter how advanced, welcome foreign investments to their economy.

This is the essence of globalization and no country in the 21st century can be an island. Our reforms are therefore designed to prepare Nigeria for the 21st century.

“Finally, let me commend Nigerians for your patience, steadfastness and perseverance. You know that I am trying to do the right things for our country.”

Benefits of early morning s.e.x

      
Prof. Musa Yakubu of University of Ilorin has said having s*x in the early morning lowers blood pressure and reduces risks of heart attack.

Yakubu of the Department of Biochemistry made the assertion in a paper, “Knocking Down the Barriers to Four O’Clock Activities and Reproductive Inadequacies”, presented at the 163rd Inaugural lecture of the university on Friday.

He said that having s*xual intercourse, three to four times a week, was good for love life.

“Research has shown that s*x boosts immune system by stimulating the body’s first line of defence and production of immunoglobulin A (IgA), against cold and fever,” he said.

Immunoglobulin A is one of the most common antibodies in the body system.

Antibodies are proteins made by the immune system to fight bacteria, viruses, and toxins.

S*x, according to Yakubu also regulates menstruation in women by influencing the levels of lutenizing hormones that control menstrual period and promote better sleep.

He said s*x also releases the feel-good chemical, known as oxytocin, which enhances closeness with one’s partner and makes people feel happier for a longer period of time.

“Lovemaking of about 20 minutes reduces 150 calories,” he said.

The professor of Biochemistry postulated that s*x is the most powerful creative force given to human by God for pleasure and deep companionship.

Yakubu, however, noted that any marriage in which the man or woman could not enjoy s*xual intercourse or satisfy their partner in bed was a dead marriage.

He said lack of s*xual satisfaction had led to the collapse of many marriages in Nigeria, and urged couples to seek for solutions to the problem.

“S*xual and reproductive dysfunctions are common among men and women in Nigeria, which necessitates regular screening and check-ups,” he said.

He also said that traditional medicines had been authenticated to cure s*xual dysfunctions.

PDP godfathers have been put to shame finally – Oshiomhole

      
Gov Adams Oshiomhole of Edo state and the governor-elect of the state, Godwin Obaseki with thousands of supporter of the party, embarked on a road show in the streets of the Benin City yesterday to celebrate the election victory, with the governor describing the emergence of the Obaseki as the next governor of the state as the final burial of the “PDP godfathers”.

Addressing the crowd at Ring Road, Oshiomhole declared that “God Almighty have vindicated me when I said the lies of the evil people will never triumph. Edo people have spoken today loud and clear that never again will they go back to the dark days. Never gain will the funds made for their well being, for development be diverted into private pockets.
“Never again will they use the state funds to celebrate birthdays and never again will they use your money for soup at Igueben. In the course of this celebration, I passed through the residence of Chief Igbinedion and I saw a canopy but nobody there, the place looks like a deserted house.

I told them what they plot at night, during the day God will reveal them to His people.
“They said they will disgrace Oshiomhole in this election because they were plotting evil during the elections but God thwarted all their plans and I told our people these people want to kill us because of election but they will never succeed. And I want to thank security agents who worked so hard to ensure that those evil people were apprehended.

“Just look at the result of the election, Igbinedion lost his ward, Ikimi was defeated in Igueben and that is because these people have lost touch with the people. They from the sweat of the poor and I said no, it cannot happen anymore. Over the last eight years we have tried to orientate our people not just the voters but politicians that the season of election rigging where one or two godfathers write the results is over and we were committed to dismantling the rigging machine.

“We have a rerun in 2012 with all the godfathers on one side and new forces of change on my side, I won in all the 18 local government areas. Our people have spoken loud and clear that they believe in democracy, they just don’t want to be beneficiaries, they want to be the drivers of the process. This was shown by the way they conducted themselves on Election Day.

“It is outstanding and remarkable that tensed as the election was with all the predictions the APC out of 18 local government we won in 15 decisively based on the fact that we won 25 per cent from two other Local Governments apart from the 13 we won decisively. Those who were loudest in making noise has been revealed where they stand in relation with Edo people.

“We have humbled Chief Tom Ikimi even in the local government he claimed to have created. We defeated Chief Raymond Dokpesi in his polling unit, his Ward and his local government. That reassures that the ruthless deployment of media machinery is not enough to distort the will of Edo people to determine their choice.

“In Okada, the political family that has boasted that they will continue to govern this state and even compelled the state to adopt them as the queen of England whose birthday must be celebrated. In Okada, the APC was the preferred party by the people than that family in Okada.

“There is something unique in the way things have turn out. In Esan land, the senatorial zone of the PDP godfather, we won two out of the five local government. We gave him a fight that he manages to escape. He used the factor of his age to play on the emotion of the people. It is a victory for the people of the state. Edo people are now proud they can now determine who rule them and no one godfathers can choose a leader for them. When you look at the propaganda, you will think we have fell for the lion but they failed” he declared.

Angry Jose Mourinho slams his assistant

   
Jose Mourinho angrily lashed out at one of his assistants during Manchester United’s 1-0 win over Lorya Zuhansk in the Europa League on Thursday.

The Portuguese took out his frustrations at Giovanni Cerra for getting the opposition line-up wrong as he walked over to his assistant in the dug-out before slamming shut his laptop, reports the Daily Mirror.

An angry Mourinho said after United's 1-0 Europa League win over Ukrainian minnows Zorya Luhansk: “It was set pieces, organisation, they changed their team before the game.

“Paul Pogba was a bit confused with the changes and obviously I want my assistants to take care of all the details.”

The former Chelsea boss was however happier with Wayne Rooney, as he came of the bench to set up Zlatan Ibrahimovic for the winner with a scuffed shot within two minutes of his introduction.

“He was laughing that he could say he made a good assist!” he said.

“But really, he gave us at that time what we needed, which was a second presence in the box.

“He’s more of a striker than Juan Mata, who went to the right side.

“It was hard work. We deserved to win and we tried to win, but it was difficult. They were very well organised defensively, which we expected.”

Video shows APGA candidate tearing ballot papers

     
A video which has gone viral on the internet has shown candidate of the All Progressive Grand Alliance (APGA), Mr. Osaro Onaiwu, tearing ballot papers at the polling unit where he voted in Oredo local government area.

The video, which lasts about two minutes, recorded Onaiwu shouting and tearing ballot papers at a polling unit and walking to another polling unit.

A boy in the video was seen throwing a table away while other electoral materials were scattered on the ground.

When contacted for comments, Onaiwu confirmed tearing the ballot papers but claimed that the ballot papers were earlier snatched by some thugs he said were working for the APC.

His words, “The video they are showing, that is my polling unit. APC thugs brought thugs and took the ballot away. They brought them back and said we should continue counting.

“I said no and refused the papers to be counted. That was how I threw the ballot papers away.

“I am not a coward. You cannot return ballot papers that were earlier taken away.

“All my family members voted for me there and I am expected to win.

“Let them be sharing the video online.”

Onaiwu also led a protest against the results released by INEC on the governorship polls.

He said it was wrong for INEC to declare results in an election marred by irregularities.

The APGA candidate said he could not have got 876 votes after carrying out rigorous campaigns across the 18 local government areas of the state.

He said the police cannot stop anybody from carrying out protests against the outcome of an election conducted by INEC in the state.

Onaiwu alleged that his results were manipulated because he refused to give bribe to some INEC officials, adding that votes from the Igbo and Esan were not added.

Why we upheld Kogi gov’s election — Supreme Court

     
The Supreme Court yesterday advanced reasons why it upheld the election of Yahaya Bello as the governor of Kogi State.

The court said it could not have held otherwise because neither James Faleke (running mate to the late Abubakar Audu) nor Idris Wada (the candidate of the Peoples Democratic Party, PDP) was qualified to be made governor.

Justice Kudirat Kekere-Ekun, who read the reasons for the lead judgment in the appeal by Faleke, said that the All Progressives Congress (APC) was right in substituting the late Audu with Bello.

She added that the Independent National Electoral Commission (INEC) was in order in allowing the substitution and allowing Bello to inherit the votes scored by the Audu/Faleke joint ticket in the November 21 election.

Justice Kekere-Ekun said since it is the party that contests election, with the candidate as its agent, it has the power to substitute a deceased candidate once it is done within the law.

She held that Falake was not qualified to be made a replacement for the deceased candidate because he did not obtain nomination form and did not participate in the primary election.

Justic Kekere-Ekun said since there was no return and declaration made by INEC in respect of the November 21 election, it was wrong to conclude that the Audu/Faleke ticket had won the election before the December 5 supplementary election.

She said that before the sudden death of Audu, after the November 21 governorship election, INEC had already declared the election inconclusive and that since the election was not completed and the final result issued by INEC, Faleke, as a running mate, could not seek to inherit victory in the election.

In upholding the substitution of Audu with Bello, the court said, in the face of the law, Bello was the approprite substitute having obtained nomination form, taken part in the primary election and come second, as against Faleke who did not meet the same condition.

The court further said that by virtue of Section 221 of the Constitution, Bello, having become candidate of APC, and legally sponsored by the party, was qualified to claim the 240, 867 votes earned by the Audu/Faleke ticket on behalf of the party in the November 21 election.

The court further held that by virtue of the provision of Section 221, political parties canvass for votes and are voted for. It added that it was only the candidates duly sponsored by political parties that can lay claim to the votes earned by the party.

It added that, Faleke, having not been sponsored by the APC as its candidate in the supplementary election, could not seek to inherit the votes earned by the party in the election.

Justice Sylvester Ngwuta, who read the reasons in the lead judgment in the appeal by Wada, said the ex-governor failed to prove his allegation that the election was held in violation of the Electoral Act.

He also upheld the choice of Bello as a replacement for Audu as against Faleke.

The court said: “While Section 36(1) of the Electoral Act (EA) made provision for what should be done in the event of the death of a nominated candidate after the delivery of nomination paper, but before the commencement of the poll, neither the EA (2010) nor the Constitution provided for what to do in the event of the death of a candidate after the commencement of the poll as in the case at hand.

“The death of the original candidate of the 2nd respondent (APC) after the commencement of the poll in November 21st election in Kogi State left a yawning gap in the nation’s electoral process without any provision for filling the gap.

“In the situation such as this, it amounts to abdication of duty for the electoral umpire and the tribunal and court to fold their hands and bemoan the fact that the Legislature failed to do the impossible – providing for all exigencies both in the present and the future in their legislative duties.

“The 2nd respondent and INEC rightly resorted to substitution of the deceased candidate with the 1ts respondent (Bello). I think that the decision of this court in Amaechi v. INEC (2008) 5 NWLR (pt. 1080) 227 at 296 encompasses the situation created by the death of the 2nd respondent’s candidate. The decision finds support in Section 221 of the Constitution.

“A political party is an abstraction. It has to canvass votes through its members as agents, in the same way it contests, wins or loses elections through a candidate it nominates, who acts as its agent.

”There is no provision for independent candidates. The candidate nominated to contest at an election by his party acts as an agent of his party. He is, as it were, an agent of a disclosed principal, and, as far as third parties are involved, benefits and liabilities accruing to the candidate (as agent) belong to his party (the disclosed principal. “If an agent (candidate) of the party dies, or withdraws from the contest, the political party can substitute the dead candidate or the candidate, who withdraws from the election with another candidate (agent) subject to the provisions of the Act. There is continuity as the new candidate starts and continues from where the previous candidate stopped.“

In resolving the question of whether or not Bello contested the election without a running mate, the court held that it could not be said that he ran without a running mate as required under the law.

“Now if the court below (Court of Appeal) did not pronounce on the appellant’s contention that Hon. Faleke was not adopted as the running mate of the 1st respondent, it is because the matter had become academic as the issue of nomination of running mate is not within the jurisdiction of the tribunal and ipso facto, the court below cannot pronounce on it.

“But that notwithstanding, did Hon. Faleke withdraw his nomination in accordance with Section 35 of the Act? The answer is in the negative for the simple reason that the purported withdrawal was wrongly addressed to the 3rd respondent (INEC) and not to the political party that nominated him.

“For all intents and purposes, he remained the running mate to the 1st respondent at all material times.” the court said.
